1. Purpose

These Terms of Use (hereinafter "Terms") define the terms and conditions under which LAMADEEP (hereinafter "the Publisher") provides its services through the platform accessible at lamadeep.com (hereinafter "the Platform").

By accessing and using the Platform, any user (hereinafter "the User") accepts these Terms without reservation.

2. Description of Services

Lamadeep is a collective intelligence and AI orchestration platform that offers:

• AI conversational assistant: intelligent chatbot with multi-model orchestration (OpenAI, Anthropic, Mistral AI, Cohere, Google AI, open-source models)
• Content generation: creation of presentations, podcasts, videos, voicemail greetings and hold music
• Document management: import, analysis and intelligent retrieval of documents
• Collaborative tools: knowledge sharing within organizations
• Automate-Lamadeep: connection to third-party tools (CRM, ERP, external APIs) at users' request
• Professional services: consulting, training and custom deployment

3. Access to the Platform

3.1 Registration

Access to services requires the creation of a user account. The User agrees to provide accurate, complete and up-to-date information during registration and to keep it current.

3.2 Credentials

The User is solely responsible for the confidentiality of their login credentials. Any use of the Platform made with their credentials is presumed to have been made by the User. In the event of suspected unauthorized use, the User must immediately notify Lamadeep at support@lamadeep.com.

3.3 Age Requirements

Use of the Platform is restricted to persons aged 16 or older, or the minimum legal age required in the User's country of residence.

4. Subscriptions and Pricing

4.1 Plans

The Platform offers various subscription plans (free, professional, enterprise) whose features and pricing are detailed on the website's pricing page.

4.2 Free Trial

A free trial may be offered to allow the User to test the Platform's features. At the end of the trial period, the User may choose to subscribe to a paid plan or stop using the service.

4.3 Payment

Payments are securely processed through Stripe. The Publisher does not store any banking data. Subscriptions are billed according to the chosen frequency (monthly or annual) and are automatically renewed unless cancelled by the User.

4.4 Cancellation

The User may cancel their subscription at any time from their account settings. Cancellation takes effect at the end of the current billing period. No pro-rata refund will be issued for the remaining period, except as required by applicable law.

5. Intellectual Property

5.1 Publisher's Rights

The Platform, its architecture, source code, interfaces, text, graphics and all constituent elements are the exclusive property of LAMADEEP or its licensors. They are protected by copyright, trademark law and applicable intellectual property legislation.

5.2 User-Generated Content

The User retains ownership of all content they create, import or generate through the Platform (documents, presentations, podcasts, videos, voicemails, etc.). By using the Platform, the User grants Lamadeep a limited, non-exclusive and revocable licence to host, process and display such content solely for the purpose of providing the service.

5.3 AI-Generated Content

Content generated by artificial intelligence models through the Platform is made available to the User as part of their subscription. The User is responsible for the use they make of such content and must verify its accuracy before any distribution.

6. User Obligations

The User agrees to:

• Use the Platform in accordance with these Terms and applicable laws
• Not use the Platform for unlawful, fraudulent purposes or in violation of third-party rights
• Not attempt to circumvent security measures or access unauthorized areas of the Platform
• Not introduce viruses, malware or any harmful code
• Not engage in systematic data extraction (scraping) without prior authorization
• Not use content generation services to produce illegal, defamatory, discriminatory, violent content or content that infringes human dignity
• Respect third-party intellectual property rights when importing documents

7. Artificial Intelligence and Responsible Use

7.1 Nature of AI Responses

The Platform uses artificial intelligence models that provide automatically generated responses. These responses are provided for informational purposes only and do not constitute professional advice (legal, medical, financial or otherwise). The User is solely responsible for verifying and using these responses.

7.2 Multi-Model Orchestration

Lamadeep acts as an independent orchestrator coordinating various AI systems. The Publisher does not guarantee the permanent availability of all proposed models, as these are provided by third-party vendors.

7.3 AI Limitations

AI models may produce inaccurate, incomplete or outdated responses. The User acknowledges these limitations and agrees to exercise critical judgment before using or distributing generated content.

8. Availability and Maintenance

The Publisher endeavours to ensure the Platform's availability 24 hours a day, 7 days a week. However, access may be temporarily interrupted for maintenance, updates or in the event of force majeure.

The Publisher will inform Users, where possible, of any scheduled interruption.

9. Liability

9.1 Limitation of Liability

The Platform is provided "as is". The Publisher shall not be held liable for:

• Indirect, consequential damages or data loss resulting from the use of the Platform
• Inaccuracy of content generated by artificial intelligence models
• Temporary unavailability of the Platform or certain third-party services
• The User's use of content generated through the Platform
• Consequences related to the connection of third-party tools via Automate-Lamadeep

9.2 Force Majeure

The Publisher shall not be held liable in the event of force majeure, including network failure, natural disaster, war, epidemic, government decision or any event beyond the Publisher's reasonable control.

10. Personal Data Protection

The processing of Users' personal data is governed by our Privacy Policy, which forms an integral part of these Terms. The Publisher is committed to complying with the General Data Protection Regulation (GDPR) and all applicable data protection laws.

11. Suspension and Termination

11.1 By the User

The User may delete their account and stop using the Platform at any time. Account deletion results in the permanent deletion of all associated data after a 30-day retention period.

11.2 By the Publisher

The Publisher reserves the right to suspend or terminate, without notice, a User's access in the event of a breach of these Terms, fraudulent behaviour, or abusive use of the Platform. The User will be notified by email.

12. Amendments to the Terms

The Publisher reserves the right to amend these Terms at any time. Amendments will take effect upon publication on the Platform. Users will be notified by email or notification in the event of a substantial change.

Continued use of the Platform after amendment of the Terms constitutes acceptance of the new conditions.

13. Governing Law and Jurisdiction

For consumers residing in the European Union, and in accordance with applicable regulations, it is possible to use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr.
